Rules and regulations for granting and using
of the Stalowa Wola City Card "LifeStal"

§ 1.
Basic terms.

The terms used in these regulations shall mean:

  1. Resident'sCard, City Card or LifeStal City Card - a card constituting a data carrier in the form of a plastic physical card or a virtual card in the "LifeStal" mobile application entitling to use discounts, rebates and preferences offered to card users by the Stalowa Wola Municipality and Partners of the programme entitled "Stalowa Wola City Card - LifeStal".
  2. Physical card - Resident's card carrying a contactless electronic plastic card with a chip, having an individual number programmed by the memory chip producer and personalised by putting on its front side the name and surname of the Card User, card number and graphic design specified in the Ordinance, authorising to use concessions, discounts and preferences offered under the "Stalowa Wola City Card - LifeStal" Program.
  3. The "Stalowa Wola City Card - LifeStal" - Municipal Application of the City of Stalowa Wola" or application - a mobile application, i.e. software working on mobile devices, functioning on devices with the iOS and Android operating systems, available for download free of charge on digital distribution platforms App Store and Play Store. The application is linked to the System and the System user account.
  4. Virtual Card - Resident's Card available through the "LifeStal" Application, having an individual number assigned to the participant of the Programme by the Programme Organiser, entitling to take advantage of the concessions, discounts and preferences available under the Programme, represented by a barcode, QR code or NFC mode.
  5. Programme Organiser - Stalowa Wola Municipality.
  6. Programme - the programme entitled "Stalowa Wola City Card - LifeStal", introduced by way of Resolution No. III/19/2024 of the Municipal Council in Stalowa Wola of 14 June 2024 on introduction of the programme entitled "Stalowa Wola City Card - LifeStal" on the area of the Stalowa Wola Municipality.
  7. Municipality - Stalowa Wola Municipality.
  8. Card User or Programme Participant - a person to whom entitlements arising from the Programme were granted and a physical Card was issued or access to a virtual Card was granted, confirming entitlements arising from the Programme.
  9. LifeStal City Card System or System - a set of cooperating IT devices and software, ensuring processing and storage, as well as sending and receiving data through telecommunication networks by means of a terminal device appropriate for a given type of network.
  10. System User - a person who has gained access to the Resident Card System. The System User may be in particular the Card User.
  11. Applicant - person applying for participation in the Program and for the issue of a Resident's Card.
  12. Guardian - the child's parents and foster parent, the person running a family child care home legal guardian, the guardian for a disabled person or the guardian of a partially incapacitated person.
  13. Child - A person under the age of 18, unless the child attains the age of majority earlier in accordance with the law relating to the child.
  14. Partner - an entity participating in the Scheme, offering concessions, discounts and preferences to the Resident Card User and exercising the rights under the Resident Card in agreement with the Municipality.
  15. Card portal - website www.lifestal.pl being a part of the Resident Card System, enabling the creation of an individual account of a System User, submission of applications to join the Programme and access to the virtual Card, and issuance of the physical Card; the portal provides information on news, events, discounts, reductions and preferences offered to Programme Participants by the Partners.
  16. Contractor - BPROG Spółka z ograniczoną odpowiedzialnością with registered office in Ząbki (05-091), ul. Wojska Polskiego, nr 18, lok. 1, entered in the Register of Entrepreneurs of the National Court Register under KRS number: 0000554257.

§ 2.
General provisions.

  1. These Regulations define the terms and conditions of issuing and using the "LifeStal" City Card, referred to in Resolution No. III/19/2024 of the Stalowa Wola Town Council of 14 June 2024 on introducing the programme entitled "Stalowa Wola City Card - LifeStal" on the territory of the Stalowa Wola Municipality.
  2. Entitlements resulting from the Programme may be assigned to the Virtual Card in the mobile application.
  3. Within the Program, concessions, discounts and preferences are granted to persons whose place of residence and/or personal tax payment is the Stalowa Wola Municipality and who meet the conditions specified in the regulations.
  4. The Resident's Card confirms the entitlement of the Card User to use the reductions, discounts and preferences currently offered by the Partners and the Programme Organiser.
  5. The Physical Card or the Virtual Card is not a credit card, payment card, ATM card or enables any other form of payment.
  6. The Programme aims to:
    1. strengthen the sense of local identity of residents;
    2. increasing accessibility to city facilities, activities and cultural, sporting and recreational events;
    3. creating resident-friendly living and development conditions;
    4. expanding the range of leisure activities on offer
    5. promotion of the Municipality as an attractive place to settle;
    6. promotion and facilitation of access to the municipal transport network;
    7. developing awareness of regional products, businesses operating in the Municipality and access to services provided.

§ 3.
Confirmation of entitlements and method of issuing the Resident Card.

  1. Eligibility to use the system of concessions, discounts and preferences in the implementation of the Programme is confirmed by the Programme Organiser.
  2. Issuance of the physical Card or activation of the virtual Card by the Programme Organiser means confirmation of the rights of the Cardholder.
  3. The Resident's Card is a personalised document. The Resident Card may only be used by the person whose data has been entered on the card.
  4. Confirmation of eligibility and the issue of the Resident Card is carried out on the basis of an application form signed by an authorised adult or a Guardian in the case of under-age users of the Card.
  5. An application form is introduced, which constitutes attachment No. 2 to the Ordinance No. 261/2024 of the Mayor of Stalowa Wola dated 2024, entitling to use the Resident's Card for natural persons having their place of residence on the territory of Stalowa Wola Municipality, who in particular settle their personal income tax in the Tax Office in Stalowa Wola with the indication of the City of Stalowa Wola as their place of residence, regardless of the fact whether they earn income or not, and also to members of their families within the meaning of Art. 6 item 14 of the Social Welfare Act of 12 March 2004 (Journal of Laws 2023.901 as amended), hereinafter referred to as "Eligible Persons."
  6. The own children of the persons referred to in paragraph 5 and children under their legal guardianship are also entitled to benefit from the Programme:
    1. until they reach the age of 18;
    2. until they reach the age of 26 - in the case of young persons in education;
    3. without age limit in the case of disabled children under the care of a parent.
  7. Application for a Resident Card is made either by submitting the application in person in paper form or electronically through the Portal or the Application by completing the application form and attaching:
    1. a photograph of the Resident or the Resident's child in file format: JPG, PNG with a size of at least 250 x 350 pixels, at a resolution of 300 dpi.
    2. a document confirming the Resident's status as a student, in the case referred to in paragraph 15
  8. Confirmation of the identity of the person applying for entitlement to use the City Card on behalf of themselves or the child on whose behalf the applicant is entitled to act is:
    1. Trusted Profile
    2. Presentation of necessary documents to an employee of the Stalowa Wola Town Hall authorised to verify applications for granting the Resident Card
  9. The Programme Organiser may request the presentation of the following documents when submitting an application for a Resident Card:
    1. confirmation of the degree of relationship, especially in a situation where the surname of the child and the Guardian differ;
    2. certificate of registration to the National Taxpayer Identification Number (NIP) in the case of foreigners who do not have a PESEL number;
    3. proof of payment of the fee, if required.
  10. On behalf of a person under 18 years of age, the application is submitted by the Guardian.
  11. The application for issuance of a physical Resident Card may be submitted in writing or electronically, via the System, and its template is enclosed as Appendix No. 2 to the Decree No. 261/2024 of the Mayor of Stalowa Wola dated 2024.
    If the documents are submitted in writing, the duly completed and signed application for the issuance of a physical Resident Card, together with the required attachments, should be submitted directly to the Town Hall of Stalowa Wola or any other point accepting applications.
  12. The Program Organizer performs formal and content-related verification of the application. In case of submission through the System and in case of any irregularities, the applicant will be asked to complete the application at the place of submission, by e-mail, telephone, SMS or letter.
  13. The Physical Card, after the application has been processed, is issued at the Municipal Office in Stalowa Wola or at any other point where applications are received.
  14. The Resident Card is issued:
    1. for an indefinite period of time, whereby the Card User will be required to confirm the statement made in the application regarding residence and/or payment of personal income tax at the Tax Office in Stalowa Wola, every 12 months from the moment of activation of the City Card, on pain of its temporary deactivation until the above condition is confirmed again. Issuance of the Resident's Card to an adult who is studying and has no income up to the age of 26 requires the presentation of a document confirming study - school or student card or relevant certificate and confirmation of , every 12 months from the moment of City Card activation, on pain of its temporary deactivation until the above condition is confirmed again.
  15. In the event of loss, destruction or misplacement of the Physical Card, a duplicate shall be issued upon request. The issuing of a duplicate does not change the validity period of the Physical Card.
  16. A Physical Resident Card is issued:
    1. free of charge in the case of the first copy;
    2. against payment, in the case of a duplicate card issued at the request of the user, where the cost of issuing the duplicate card, subject to the provisions of paragraph 16, is PLN 30.00 (in words: thirty zlotys 00/100). Payments for the issuance of a duplicate should be made to the following bank account of the Municipal Office of Stalowa Wola: 06 1020 4913 0000 9202 0117 4630, in the title of the payment, first and last name of the Municipal Card holder and include the note: payment for issuance of a duplicate Municipal Card.
  17. A change of the name or surname of the holder printed on the Resident Card or a defect in the electronic layer of the proximity card without visible mechanical damage requires issuing a duplicate of the Card and is free of charge.
  18. The organizer of the program reserves the right to scan the application and attachments to the submitted Card application and process them in the System.

§ 4.
Principles of using the Resident Card.

  1. The Resident Card is a confirmation of entitlement to use the system of concessions, discounts, city services or preferences covered by the Program.
  2. The user of the City Card may only use the currently valid concessions, discounts and preferences indicated in the list published on the website and mobile application.
  3. The concessions, discounts and preferences of the Resident's Card shall not be cumulative with other concessions and discounts, unless the Programme Organiser or the Partner has established other rules for concessions and discounts.
  4. All concessions, discounts and preferences resulting from the Programme are temporary.
  5. At the request of the Programme Organiser or the Partners offering concessions, discounts and preferences, the User of the City Card is obliged to present it or provide a temporary identification number generated by the mobile application. Failure to show the Resident Card or to provide the identification number may be the reason for refusal to take into account the entitlements resulting from the possession of the Resident Card.
  6. The user of the Resident Card is obliged to:
    1. protect the Resident Card against loss or destruction;
    2. to inform the Municipal Council of Stalowa Wola immediately of the loss of his/her rights to use the Resident's Card and to return it at the same time.
  7. The Resident Card is assigned only to the Card User and may not be made available to third parties.
  8. The Stalowa Wola Municipality is not responsible for making the Resident Card available to third parties by the Card User.
  9. In case of loss, misplacement or damage of the Resident's Card, the Card User is obliged to immediately inform the Municipal Office of Stalowa Wola about this fact by e-mail or in person at the Municipal Office.
  10. The Organizer reserves the right to amend and update these Regulations.

§ 5
Partners of the Resident Card Program

  1. In order to carry out the Program, the Organizer of the Program will cooperate with Partners who will offer benefits to Residents.
  2. The basis for participation in the Program is the conclusion of an agreement.
  3. The application of a Partner to participate in the Programme is made by contacting the office of the Business Service Centre, mail: cop@stalowawola.pl, tel: 15 643 35 62, 15 847 93 15.
  4. The Resident Card is a document that confirms and entitles its holder to the benefits offered by the Partners who express their willingness to cooperate and join the Resident Card Programme.
  5. It is forbidden for the Partner to place on the website and in the Application any content contrary to the law and to organise events and promotions within the framework of the Program, under pain of termination of the agreement, which in particular:
    1. contain pornographic elements and content;
    2. incite hatred or violence towards any organisation, person or group of persons;
    3. contain discriminatory content, in particular on the grounds of race, religious beliefs, gender, sexual preference or nationality;
    4. violate the good name of the Municipality;
    5. promote alcoholic products, including beer or promote the brands of alcohol producers through non-alcoholic products, e.g. non-alcoholic beer and drugs, intoxicants or drugs with psychoactive effects;
    6. violate accepted principles of social conduct and good morals;
    7. promote attitudes that infringe animal rights,
    8. encourage the use of tobacco products;
    9. contravene the Code of Ethics for Advertising.
  6. Banners and links to other websites or websites may be published in the Application and on the Portal, including, in particular, banners and links to the websites or websites of Partners. By using the banners and links referred to in the preceding sentence, the User navigates to websites or services managed by entities other than the Operator, including, in particular, the Partners, which are responsible for the content of these websites or services, as well as for the processing of personal data of visitors to these websites or services.
  7. It is possible to learn about the total range of products and services of the Partners and the Operator offered under the Programme, as well as the individual Profits:
    1. via the Mobile Application;
    2. via the Portal;
    3. in social media; the list of current addresses of sites (profiles) referred to in the preceding sentence is available each time in the Mobile Application or on the Portal.
  8. The list of Profits to which the participants of the Programme are entitled will be posted on the Programme website and in the Application.
  9. Information about the Program and Partners, news, events, promotions and other important information about the Program will be posted on the Portal and in the Application in order to inform the Residents about the Profits they are entitled to.

§ 6
Loyalty programme in the LifeStal app

  1. The Loyalty Programme for persons entitled to use the City Card to collect points for participation in certain City activities and to exchange these points for rewards, as well as to benefit from other Benefits that do not require the use of points.
    1. A list of activities and details of point collection and available rewards are available on the Programme website: www.lifestal.pl and on the App.
  2. Users are entitled to:
    1. collect points for activities according to the rules set out in the Programme;
    2. exchange the points collected for rewards available through the Programme;
    3. use the functionality of the "LifeStal" application to keep track of points collected and rewards available.
  3. Users are required to:
    1. comply with the rules set out in the Terms and Conditions and the guidelines published on www.lifestal.pl;
    2. to participate honestly in the Programme and not to attempt to cheat or manipulate in order to gain points.
  4. Partners participating in the Programme are obliged to:
    1. make available the possibility of collecting points for activities according to the established rules;
    2. regularly inform the Organiser about the points awarded to Users;
    3. ensure the availability of prizes to be exchanged for collected points, in accordance with the current offer published on www.lifestal.pl;
    4. comply with the rules of cooperation defined in the agreement with the Programme Organiser.
  5. Partners have the right to:
    1. propose new activities to be included in the Programme after approval by the Organiser;
    2. make changes to the availability of prizes after prior agreement with the Organiser.
  6. The Programme Organiser reserves the right to make changes and updates to the Programme, including changes to point conversion rates, activities entitling you to collect points and the range of prizes. All changes will be published on www.lifestal.pl and in the "LifeStal" application.

§ 7
Personal Data Protection

  1. The Administrator of Users' personal data within the meaning of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (Journal of Laws of the EU. L. of 2016 No. 119, p. 1 as amended) - hereinafter referred to as RODO, of the Participant is the President of the City of Stalowa Wola, 1 Kwiatkowskiego Street, Stalowa Wola, um@stalowawola.pl, hereinafter referred to as the Administrator.
  2. The Administrator has appointed a Data Protection Inspector, who can be contacted by e-mail: iod@stalowawola.pl or in writing to the Administrator's registered office address. The Data Protection Officer can be contacted in all matters concerning the processing of personal data and the exercise of rights related to data processing.
  3. The User's personal data will be processed for:
    1. implementing the Programme. This is necessary for the performance of a task carried out in the public interest, which consists in the implementation of activities promoting the City, addressed to the individual resident, by granting him/her concessions, discounts and preferences;
    2. sending notices related to the implementation of the Programme by the Organiser in paper form or by means of electronic communication, conducting surveys, promoting competitions, sending newsletters and promotional offers of the Programme partners by the Organiser by means of electronic communication in accordance with the Act of 18 July 2002 on electronic provision of services.
  4. Users' personal data will be processed on the basis of:
    1. Art. 6 (1) (e) RODO processing is necessary for the performance of a task carried out in the public interest in connection with the provisions of Art. 7 (1) (18) of the Act of 8 March 1990 on Municipal Self-Government and in connection with Resolution No. III/19/2024 of the Municipal Council in Stalowa Wola of 14 June 2024;
    2. Art. 6 par. 1 lit. a) RODO - voluntary consent, which may be withdrawn at any time. The withdrawal of consent does not affect the legality of processing, which was performed on the basis of consent before its withdrawal.
  5. The Participant's personal data may be disclosed to entities and persons authorised by law. In addition, the data may be disclosed to entities with whom the administrator has concluded a contract for the provision of maintenance services for the IT systems used in their processing.
  6. Once the User's personal data has been processed for the purpose for which it was collected, it will be processed for archival purposes and stored for a period resulting from the provisions of law and internal regulations on data archiving in accordance with the archival categories referred to in appendix No. 2 to the Regulation of the Prime Minister of 18 January 2011 on the Registry Instruction, Uniform Material File Lists and the Instruction on the Organisation and Scope of Activities of Company Archives. in the case of personal data processed on the basis of consent - also until its withdrawal.
  7. In the event that specific provisions do not provide otherwise, the User is entitled to:
    1. pursuant to Article 15 RODO the right of access to personal data concerning him/her, including the right to obtain a copy of the data;
    2. pursuant to Article 16 RODO, the right to request the rectification (amendment) of personal data;
    3. The right to erasure - shall be exercised within the grounds and under the conditions set out in Article 17 RODO;
    4. The right to restrict processing - shall have the right under the grounds and conditions set out in Article 18 RODO;
    5. The right to data portability - is exercised under the grounds and conditions set out in Article 20 RODO;
    6. The right to object to processing - shall be exercised under the grounds and conditions set out in Article 21 RODO;
    7. The right to lodge a complaint to the supervisory authority (President of the Office for Personal Data Protection);
    8. to withdraw consent to the processing of personal data (but only in relation to personal data that is processed on the basis of consent - the Participant has the right to withdraw consent to the processing of personal data at any time. The withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal. Withdrawal of consent can be done in the same form as the consent was given).
  8. The provision of personal data by the Participant is voluntary, but failure to provide such data will prevent the Participant from joining the Programme.
  9. No automated decision-making or profiling takes place in the processing of the Participant's personal data.
  10. The Participant's personal data will not be transferred to a third country/international organisation.
  11. The Participant has the right to object if:
    1. there are reasons related to your particular situation, in the case of processing based on a task carried out in the public interest or in the exercise of public authority by the Administrator;
    2. the processing is necessary for purposes deriving from a legitimate interest pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.

§ 8
Comments

  1. Information on specific risks related to the use by Users of the services provided electronically under the Programme. Potential risks include:
    1. malware (Malware) - various types of applications or scripts that have a harmful, criminal or malicious effect on the User's ICT system, such as viruses, worms, trojans;
    2. Spyware - programs that track a user's activities, collect information about the user and send it - usually without the user's knowledge or consent - to the author of the program;
    3. Spam - unsolicited e-mails sent simultaneously to multiple recipients, often with advertising content;
    4. Phishing for personal confidential information (e.g. passwords) by impersonating a trustworthy person or institution;
    5. hacking - hacking into a user's IT system using hacking tools;
    6. cryptanalysis - the possibility of finding weaknesses in a cryptographic system in order to enable its breaking or bypassing.
  2. In order to avoid the aforementioned risks, the User should equip his/her computer and other electronic devices that he/she uses to connect to the Internet with an anti-virus programme and a firewall.
  3. Additional information on security of the Application's use and processing of personal data can be found in Appendix No. 5 to Order No. 261/2024 of the President of the City of Stalowa Wola.

§ 9
Final Provisions

  1. These Terms and Conditions shall be governed by the laws of Poland.
  2. Any disputes arising out of or in connection with these Terms and Conditions, including its performance or interpretation, shall be resolved by a common court having jurisdiction over the seat of the Stalowa Wola Municipality.
  3. None of the provisions of the Regulations shall limit the rights of the User being a Consumer or Single Entrepreneur, which he/she is entitled to on the basis of the provisions of the law, in the case of ascertaining the existence of a provision of such nature, the provisions of the commonly binding law shall apply, and in particular the Civil Code and the Act on Consumer Law.
  4. The choice of Polish law as the basis for the Terms and Conditions does not deprive the User who is a Consumer or a Sole Trader of the protection afforded to him under provisions that cannot be excluded by way of the Agreement, under the law that would be applicable in the absence of the choice.
  5. The content of the Terms and Conditions made available may be recorded free of charge by printing them out or saving the file with the Terms and Conditions on a data carrier.
  6. The programme organiser reserves the right to amend these Terms and Conditions in the event of circumstances not foreseen at the date of their adoption or for other important reasons.
